These Terms of Service govern access to and use of the online store operated by LUXE POUR CREATIONS LLC, including consumer purchases delivered to the Netherlands.

2. Eligibility

You must have the legal capacity required to enter into the relevant purchase contract.

A minor may use the website only with the involvement and authorization of a parent or legal guardian where required.

3. Account Information

You must provide accurate and current account, payment, billing, and delivery information.

If account functions are available, you are expected to protect your login credentials and notify us promptly of suspicious access or unauthorized orders.

We will use proportionate security measures to protect accounts and transactions.

4. Product Information

We use reasonable professional care to maintain accurate product descriptions, images, dimensions, materials, colors, functions, prices, and stock information.

Colors may appear slightly different depending on the screen or device used.

If a delivered product materially differs from its description, you may request an appropriate remedy under our Return and Refund Policy and applicable consumer law.

5. Order Process

Submitting an order constitutes an offer to purchase.

An automated order acknowledgement confirms that we received the order. The purchase contract is normally formed when we send a dispatch confirmation.

Before submitting the order, you will be able to review the products, total price, VAT where applicable, payment method, delivery information, and relevant terms.

The final order button will clearly indicate that placing the order creates an obligation to pay.

6. Order Acceptance

We may be unable to accept an order where:

A product is unavailable;
The delivery address cannot be served;
Payment cannot be authorized or reasonably verified;
The website contains an obvious pricing or description error;
Accepting the order would conflict with a legal requirement.

If payment has already been collected, it will be refunded.

7. Prices and Promotions

The price displayed at checkout applies to the order.

Promotions may be subject to clearly disclosed conditions relating to dates, products, stock, location, or use limits.

If an obvious pricing or calculation error is identified before dispatch, we will explain the correct price. You may accept the corrected order or cancel and receive a refund.

We accept Visa and Mastercard.

Payment processing is governed by our Payment Policy.

9. Delivery

Delivery is governed by our Shipping Policy.

We pay the order’s shipping costs and bear the risk of loss or damage until the products are delivered to you or to a third party designated by you, other than a carrier independently selected by you.

Unless another delivery period is agreed, products will be delivered within the period required by applicable Dutch and EU consumer law.

10. Right of Withdrawal and Returns

Consumers may exercise the statutory right of withdrawal without giving a reason.

In addition, we provide a 30-day return period beginning on the day after delivery of the product. For separately delivered products from one order, the period begins on the day after delivery of the final product.

You may withdraw through:

The website cancellation button;
The Model Withdrawal Form;
A clear email statement.

Returns, exchanges, shipping costs, and refunds are governed by our Return and Refund Policy.

11. Statutory Guarantee

Products must conform to the purchase agreement and meet the quality, functionality, durability, safety, and description that a consumer may reasonably expect.

If a product is faulty or does not conform, you may have the right to repair, replacement, price reduction, or refund under Dutch and EU consumer law.

These statutory rights apply independently of any voluntary commercial return period or warranty.

Unless otherwise stated, the trademarks, brand elements, text, photographs, videos, graphics, layouts, designs, and software on the website belong to LUXE POUR CREATIONS LLC or its licensors.

Nothing in these Terms limits any responsibility or consumer remedy that cannot legally be limited, including rights relating to fraud, intentional misconduct, gross negligence, personal injury, unsafe products, statutory guarantees, or data protection.

Other remedies and responsibility will be determined by applicable law, the nature of the matter, and the relevant order.

Please include the order number and a clear description of the issue.

We will acknowledge and investigate the complaint and respond within a reasonable period.

You may also contact a competent consumer-protection authority, alternative dispute-resolution body, or court.

19. Governing Law and Jurisdiction

To the extent legally permitted, these Terms are governed by the laws of the State of Missouri, United States.

This choice does not deprive consumers in the Netherlands of mandatory protections provided by Dutch or European Union law.

Consumers may bring proceedings before any court that has jurisdiction under applicable consumer law, including a competent court in their country of residence where the law permits.

20. Changes to These Terms

We may update these Terms to reflect changes in our business, technology, or legal obligations.

The updated version will display a new effective date. Orders already accepted will normally remain governed by the version applicable when the order was placed, unless mandatory law requires otherwise.

If one provision is invalid or unenforceable, the remaining provisions continue to apply.
