2. Scope and Eligibility
These Terms govern access to the website and purchases delivered within the Netherlands. You must have the legal capacity required to enter into a purchase contract. A minor may place an order only with the authorization and involvement required by law.
3. Account and Order Information
You must provide accurate, complete, and current account, payment, billing, and delivery information. Contact us promptly if information needs to be corrected. Address and order changes can be handled only before dispatch.
4. Product Information
LUXE POUR CREATIONS LLC is responsible for maintaining clear and accurate product titles, descriptions, materials, dimensions, images, prices, package contents, availability, and use information. Screen settings may cause minor color differences. If a delivered item materially differs from its description, we will provide the remedy required by the circumstances and applicable law.
5. Order Process and Acceptance
Submitting an order is an offer to purchase. An order acknowledgement confirms receipt. The purchase contract is formed when we confirm acceptance or dispatch. Before submitting the order, you can review the products, price, applicable tax, shipping, payment method, delivery information, and relevant policies.
We may decline an order if the product is unavailable, the delivery address is outside the service area, payment cannot be authorized, the displayed price contains an evident error, or acceptance would violate the law. If payment was collected for an order we do not accept, it will be refunded to the original payment method.
6. Prices, Payment, and Promotions
The total shown at checkout is the amount charged. Payment methods are listed in the Payment Policy. Promotions are governed by the clear conditions displayed with the offer. If an evident pricing error is identified before dispatch, we will explain the correct price and allow you to accept the correction or cancel for a full refund.
7. Shipping and Delivery
LUXE POUR CREATIONS LLC arranges and is responsible for order fulfillment under the Shipping Policy. Standard shipping within the Netherlands is free. We bear the risk of loss or damage until the order is delivered to you or your authorized recipient. We will investigate and resolve delayed, lost, or damaged deliveries.
8. Cancellations and Changes
A cancellation, delivery-address change, or order change may be requested only before dispatch. Contact customer service promptly. We will confirm whether the request was completed. After dispatch, the Return, Refund & Exchange Policy applies.
9. Returns, Direct Exchanges, and Refunds
We accept authorized returns of defective and non-defective products within the 30-day return period. Authorized items must be mailed within 14 days after authorization. Original packaging is not required, no restocking fee is charged, and we pay authorized return and direct-exchange shipping costs. Approved refunds are processed to the original payment method within 5 business days after inspection; the bank or payment provider may require an additional 3-10 business days to post the funds. 10. Product Conformity and Consumer Rights
Products must conform to the purchase agreement and meet the quality, function, safety, durability, and description a consumer may reasonably expect. For a defective or non-conforming product, we will provide the repair, replacement, price reduction, refund, or other remedy required by applicable law. Nothing in these Terms reduces mandatory Dutch or European Union consumer rights.
11. Lawful Website Use
You may not commit fraud, use an unauthorized payment method, introduce malicious software, interfere with website security or operation, infringe intellectual-property or privacy rights, submit unlawful content, or use the store for transactions prohibited by law. We may take proportionate measures to protect customers, orders, and the website.
12. Intellectual Property
Unless otherwise stated, the brand elements, text, photographs, graphics, layouts, designs, and software on the website are owned by or lawfully used by the company. You may use website content for personal shopping and customer-service purposes. Commercial reproduction or distribution requires authorization.
13. Reviews and Customer Content
If you submit a review, photograph, or other content, you confirm that you have the right to submit it and authorize us to display and use it in operating and promoting the store, subject to applicable privacy and consumer law. We do not knowingly publish fabricated reviews or present reviews misleadingly.
14. Company Responsibility
LUXE POUR CREATIONS LLC is responsible for the operation of the store and for its obligations concerning product information, order acceptance, payment administration, fulfillment, delivery arrangements, cancellations, address changes, returns, exchanges, refunds, product conformity, website security, customer service, and personal data to the extent required by applicable law.
We will investigate customer complaints, correct confirmed errors, and provide the appropriate remedy. Nothing in these Terms excludes or limits a responsibility, right, or remedy that cannot legally be excluded or limited.
15. Complaints
Send complaints to luxepour@luxepourliving.com and include the order number and a clear description of the issue. We will acknowledge, investigate, and respond within a reasonable period. You may also contact a competent consumer-protection authority, dispute-resolution body, or court.
16. Governing Law
These Terms are governed by the laws of the State of Missouri to the extent legally permitted. This does not deprive a consumer in the Netherlands of mandatory protections provided by Dutch or European Union law. A consumer may bring proceedings in any court that has jurisdiction under applicable consumer law.
17. Changes and Severability
We may update these Terms to reflect operational or legal changes. The current version and effective date will be published on the website. Orders already accepted remain governed by the version applicable when the order was placed unless mandatory law requires otherwise. If one provision is invalid or unenforceable, the remaining provisions continue in effect.
